Chile Company Lookup: Two Regimes, One of Them Exempt

A Chile company lookup has to start by asking which regime a company is under. The Registro de Empresas y Sociedades (RES), administered by the Ministerio de Economía, Fomento y Turismo, holds companies formed under the simplified regime of Law 20.659; the general regime's Registro de Comercio and the Diario Oficial sit alongside it. The Servicio de Impuestos Internos (SII) issues the RUT. The RES is at registrodeempresasysociedades.cl, also reachable as TuEmpresaenUnDia.cl, with open datasets on datos.gob.cl. This guide covers a split that makes a blank result mean very little on its own. Chile company lookup: the short version

A register you were never required to enter

The single most consequential fact about looking up a Chilean company is a negative, and the RES states it:

"En el régimen simplificado de la Ley N° 20.659 no se requiere la inscripción en el Registro de comercio ni publicación en el Diario Oficial."

Under the simplified regime of Law No. 20.659, entry in the Commercial Register is not required, nor publication in the Official Gazette.

The failure mode follows directly: a blank result in the Registro de Comercio is not evidence that a Chilean company does not exist. It may be a company that was never required to be there.

Be precise about what is sourced, because the difference matters. The source states the absence of an obligation — no requirement to register commercially or to publish in the Gazette. It does not state that companies under this regime are absent from those places, and this page does not claim they are. A company might appear for other reasons; what the source establishes is that it need not.

So the routing is: the RES answers "is this company formed under the simplified regime", and the Registro de Comercio answers a different question about a different population. A reader who searches one and concludes about the other has crossed a boundary the law drew.

Four words the register uses about itself

Few registers in this programme describe themselves this compactly, and each word answers something a reader wants to know:

"El Registro es único, rige en todo el territorio de la República, es público, gratuito"

The Register is único — single, one register rather than a network of offices. It rige en todo el territorio de la República — applies across the whole national territory. It is público. And it is gratuito.

The Ministry's own description adds the mechanism: the RES is "un registro electrónico creado por la ley 20.659, a través del cual se instaura un Régimen Simplificado que permite, con mayor simplicidad y sin costo, constituir, modificar, transformar, dividir, fusionar, y disolver personas jurídicas" — an electronic register created by Law 20.659, instituting a simplified regime allowing legal persons to be constituted, modified, transformed, divided, merged and dissolved, with greater simplicity and at no cost.

And the Ministry's policy page names the same acts: the simplified system is implemented in the RES, "que es electrónico, público y gratuito, administrado por el Ministerio de Economía, Fomento y Turismo […] en el cual los Usuarios podrán celebrar actuaciones como la constitución, modificación, transformación, fusión, división, terminación y disolución de las personas jurídicas acogidas a la ley N° 20.659."

On cost the RES is explicit: "Uno de los principios fundamentales del Régimen Simplificado es la gratuidad. Esto significa que realizar una actuación no tiene costo para los usuarios." — gratuidad is one of the regime's fundamental principles: carrying out an actuación has no cost to users.

Formation, and what happens immediately after

The mechanics are unusual enough to state as the source states them:

"El Régimen simplificado facilita tanto la constitución de sociedades o migración desde el Régimen general, como las demás actuaciones y anotaciones […] a través de un formulario que una vez suscrito con la firma electrónica avanzada de todos quienes corresponde, se incorpora automáticamente al Registro de Empresas y Sociedades como documento electrónico."

The simplified regime facilitates the constitution of companies or migration from the general regime, as well as other acts and annotations, through a form which — once signed with the advanced electronic signature of all those concerned — is incorporated automatically into the Registro de Empresas y Sociedades as an electronic document.

Then:

"Después de la suscripción del formulario de constitución, y de manera inmediata, el Servicio de Impuestos Internos (SII) le otorgará un RUT a la persona jurídica."

After the formation form is signed, immediately, the SII grants the legal person a RUT.

Two things worth holding. The form becomes the register entry — there is no separate act of registration once every required signature is on it. And the tax identifier follows immediately, from a different authority, without a second procedure. Inmediata is the source's own word and this page does not convert it into a duration.

Migration from the general regime is named as something the regime facilitates. A company's regime is therefore not necessarily the one it started under, which is a second reason a single-register search can mislead.

What a Chilean company register entry contains

That governs actuaciones — doing things in the register. The sources do not say the same of consulting it, and this page does not imply either way. A reader planning to read the register should establish the access conditions independently rather than assuming the authentication requirement extends to consultation, or assuming it does not.

Where a Chile lookup stops

The open data is scoped to the regime, and that scope is the whole point of this page. The Subsecretaría de Economía publishes annual datasets on Chile's open data portal listing companies registered under the simplified regime of Law 20.659, as CSV, by date and RUT.

Those files cover companies under this regime — not all Chilean companies. A population assembled from them is a population of simplified-regime entities, and treating it as the Chilean company universe reproduces exactly the error the first section warns about.

One dated fact: Law 20.659 was amended by Law 21.366, which came into full force on 1 February 2023. What changed is not described here — the source names the amendment, not its content.

This page also does not describe the evidentiary value of certificates issued by the Register, or whether they constitute an enforceable title. That is the most consequential unknown here, and CHILE_REPORT.md flags it first: it would place Chile beside Austria, Israel, Spain and Vietnam on what a register's output is worth in law, and unlike most such questions it is a statute, so it is checkable.

Reading a blank Registro de Comercio result as non-existence. Under the simplified regime, entry there is not required.

Assuming simplified-regime companies are absent from the Commercial Register. The source establishes the absence of an obligation, not the absence of entries.

Treating the open datasets as the Chilean company universe. They list companies registered under the simplified regime of Law 20.659.

Assuming a company's regime is fixed. The regime facilitates migration from the general regime.

Extending the authentication requirement to consultation. The sources apply it to carrying out actions and procedures, and say nothing about reading.

Assuming what certificates prove. Their evidentiary value is not established on this page.

A repeatable Chile company lookup workflow

1. Establish which regime the company is under before choosing a register.
2. Search the RES for simplified-regime entities, and treat the Registro de Comercio as a different question.
3. Never conclude non-existence from one register alone.
4. Take the RUT as the stable identifier, since it is granted immediately at formation.
5. Scope any population built from the open datasets to the simplified regime explicitly.
6. Confirm the access conditions for consultation separately from those for actuaciones.
